Do you speculate Tony Stewart is guilty of an injustice or was it an accident?

Edit: There's lots of discussion going on the front page and I'm just trying to quantify the two positions people seem to be taking. I don't know what's offending certain sensitive people. Is it the car picture? I'm not trying to make light of the situation.

Too early to say definitely either way at the moment. I think the victim was very foolish to step into the track the way he did but also Stewart appears to accelerate purposefully. A difficult one to decipher.

guilty but unintentional. Speculation : as said before, he goosed the engine to scare/intimidate and lost control thus resulting in what happened.

I don't care to see a guy die, so I didn't watch the whole video, but the guy was being extremely irresponsible walking around on the track. He should never have gotten out of his car. He was walking dangerously close to the other cars, and clearly was not thinking straight. Besides, be a good sport. He was acting out, having a tantrum because he got caught on the fence. When you let your attitude run you like that, making you do dangerous things, you're just asking for problems. There's a degree of shared responsibility here, but from what I watched, Stewart didn't drive towards him. He walked towards Stewart.

It's quite possible that Tony saw Kevin and didn't know what he was going to do, which way he was going to go and sort of froze. It's also possible that Tony tried to intimidate him.
The video is not enough to prove that it was intentional, but it doesn't exactly exonerate Tony either.

That's kind of how I saw it. He looked as though he was going down to the apron, but as Stewart neared he dodged the wrong way and entered wear stewart was driving. Stewart might have been too fast to avoid him at that point.

Yeah that's what I can't get past, is the fact Stewart could have been going at nearly half the speed. The car before him managed to slow down as Ward was out on track, I have no clue why Stewart wouldn't either.

What facts? There's video footage of him being hit which, while not providing a complete picture, does show enough to warrant a discussion. And what is so insensitive about the post? I personally hate inordinate political correctness so I'm not going to tiptoe the issue but I wasn't in the least bit trying to make light of the situation. Is it the car pic? Is it the word 'guilty'?

I can't get past the fact Tony could have been going at nearly half the speed like the car before him which managed to slow down while passing Ward. I too believe he was trying to buzz him but ended up hitting him which, if it is the case, would make him guilty of manslaughter in my eyes.

guilty of an injustice or not, in your opinion. There seems to be strong opinions from people saying it's obviously murder, while others say it's obviously an accident. I'm curiously trying to quantify how many people think one way or the other.
